Terms of Service
SCOPE OF AGREEMENT
Please carefully review these Terms & Conditions (“Terms”) before booking any classes or purchasing services. These Terms govern the use of services provided by Fyre Pilates LLC, doing business as Fyre Pilates + Sculpt (“Fyre Pilates + Sculpt,” “Fyre,” “we,” “our,” or “us”). By reserving a class, purchasing a package or membership, attending a class, or participating in any services offered by Fyre Pilates + Sculpt, you acknowledge that you have read, understood, and agreed to these Terms. Together with the policies outlined below, these Terms form a binding agreement between you (“the Client”) and Fyre Pilates + Sculpt.
HEALTH & SAFETY
I certify that I have either consulted with a physician within the past year and have been cleared to participate in physical fitness activities, or I voluntarily choose to participate in classes at my own risk.
I acknowledge that participation in exercise programs, heated fitness classes, and related activities carries inherent risks, including but not limited to physical injury, illness, dehydration, or other health complications. Certain classes may take place in temperatures exceeding 100°F.
By participating, I knowingly and voluntarily assume all risks associated with these activities and release Fyre Pilates + Sculpt, including its owners, instructors, employees, contractors, affiliates, agents, and representatives, from liability arising from participation in classes, use of facilities, or use of equipment.
I confirm that I am at least 18 years old. Participants ages 16–17 must have parent or guardian consent.
INJURY, PREGNANCY & SENSITIVITIES
If you are recovering from an injury or illness, are postpartum, pregnant, or have any physical or sensory sensitivities, please notify your instructor before class begins. Heated classes are not recommended during pregnancy.
ACCOUNT INFORMATION
Clients agree to provide accurate, current, and complete information when creating an account, purchasing services, or booking classes. Clients are responsible for maintaining accurate contact and payment information.
CLASS CANCELLATION POLICY
Classes must be canceled at least 12 hours prior to the scheduled start time to avoid losing a class credit. Late cancellations and no-shows will result in the deduction of one class credit. Members who no-show or cancel late will be charged a $10 fee.
RETURNS & REFUNDS
All sales for class packs, drop-ins, memberships, workshops, events, and other services are final. Purchases are non-refundable and non-transferable. Unused merchandise may be returned within 7 days of purchase with proof of purchase.
PAYMENT AUTHORIZATION & MEMBERSHIP BILLING
By purchasing a membership, package, class, workshop, event, or other service, you authorize Fyre Pilates + Sculpt to charge the payment method provided for applicable fees. Memberships may automatically renew according to the terms selected at purchase.
MEMBERSHIP FREEZE & CANCELLATION POLICY
Membership cancellation requests must be submitted in writing to info@fyrepilates.com. Cancellation requests become effective at the end of the member's current billing cycle and do not relieve the member of any remaining commitment obligations.
Founding Memberships require a minimum six (6) month commitment. Standard Memberships require a minimum four (4) month commitment. Memberships may not be canceled prior to completion of the applicable commitment period unless otherwise required by law.
Following completion of the initial commitment period, memberships continue on a month-to-month basis and may be canceled with at least fourteen (14) days written notice prior to the next billing date.
Memberships may be frozen only for documented medical reasons. Approved medical freezes will be granted at no charge and membership commitments will be extended by the length of the freeze period.
Memberships are non-transferable and may not be shared, assigned, or transferred to another individual.
WORKSHOPS & EVENTS
All workshop and event purchases are final sale and non-refundable upon booking.
ACCEPTABLE USE
Clients agree to use Fyre Pilates + Sculpt's website, booking platform, mobile applications, and services only for lawful purposes. Misuse may result in suspension or termination of services without refund.
NON-RECORDING POLICY & CONTENT POLICY
Clients are welcome to capture photos and videos for personal use and social media, provided that such content is respectful of the studio environment and the privacy of others.
When creating content in the studio, clients may only record themselves or individuals who have provided their express consent. Recording, photographing, or otherwise capturing other clients, instructors, or staff without their permission is strictly prohibited.
Livestreaming, virtual broadcasting, or recording full classes is not permitted without prior written authorization from Fyre Pilates + Sculpt.
Fyre Pilates + Sculpt reserves the right to request that any recording cease if it disrupts the class experience, compromises client privacy, or interferes with studio operations.
By entering the studio, you acknowledge that Fyre Pilates + Sculpt may occasionally capture photography or video content for marketing and promotional purposes. If you prefer not to appear in studio-created content, please notify a member of our team.
PERSONAL BELONGINGS
Fyre Pilates + Sculpt is not responsible for lost, stolen, or damaged personal belongings brought into the studio.
NON-HARASSMENT POLICY
Fyre Pilates + Sculpt is committed to maintaining a safe, welcoming, and respectful environment. Harassment, discrimination, intimidation, or offensive conduct will not be tolerated.
INTELLECTUAL PROPERTY RIGHTS
All logos, branding, website content, graphics, videos, photographs, text, class concepts, and digital materials are owned by or licensed to Fyre Pilates + Sculpt and may not be copied or used without written permission.
GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of New York.
DISPUTE RESOLUTION
The parties agree to make reasonable efforts to resolve disputes through good-faith discussions. If a dispute cannot be resolved informally, it shall be resolved through binding arbitration in the State of New York.
CHANGES TO THESE TERMS
Fyre Pilates + Sculpt reserves the right to update or modify these Terms at any time. Continued use of services constitutes acceptance of revised Terms.
